Regarding “Clarity for Crypto, Sort Of” (Review & Outlook, Aug. 5): The editorial board is right that the Senate’s crypto bill contains policy land mines. One it overlooks is the risk that the Clarity Act could be used to expand prediction-market sports betting at the expense of tribal sovereignty and the public services tribal gaming revenues support.
Prediction-market operators argue that wagers on football games and other contests are merely event contracts governed exclusively by federal commodities law. But changing the label doesn’t change the activity. A wager on the outcome of a sporting event is sports betting.
